License Suspended for Cornwall Roadhouse

The Prince Edward Island Liquor Control Commission has suspended the lounge liquor license of the licensed premise known as the “Cornwall Roadhouse,” license number LL50172, located in Cornwall, P.E.I., for the following period of time, that is:

-for a period of two (2) days for violation of Section 70(a) of the Liquor Control Act Regulations;

-for a period of two (2) days for violation of Section 24 of the Liquor Control Act Regulations;

-for a period of two (2) days for the violation of Section 70(b) of the Liquor Control Act Regulations, said suspensions to be served consecutively; and

-three (3) days for the violation of Section 70(j) of the Liquor Control Act Regulations; said suspensions to be served concurrently;

-for a total cumulative suspension of six (6) days commencing 11:00 a.m., Monday, May 29th, 2006 and ending at 2:00 a.m., Sunday, June 4th, 2006.

An agreement was reached by the parties at a hearing held before Robert MacArthur, Adjudicator, on May 24th, 2006, that violations of the Liquor Control Act Regulations took place under the following sections:

Section 24

“The holder of a lounge license shall not permit any person under the age of nineteen years to enter the licensed premises during the hours liquor is being consumed.”

Section 70(a)

“A licensee shall not permit any liquor to be taken from or into his licensed premises otherwise than is permitted by the Act and these regulations.”

Section 70(b)

“A licensee shall not permit any disorderly conduct or the use of vulgar or profane language by any person in his licensed premises.”

Section 70(j)

“A licensee shall not sell or supply any liquor on his licensed premises to or for any person who is apparently in an intoxicated condition.”
