The Prince Edward Island Liquor Control Commission has suspended the lounge operation known as Causeway Bay Linkletter Lounge, licence number LL-60-189, located in Summerside, for the following period of time, that is: for a seven (7) consecutive day period – commencing 11 a.m., Friday, July 18, 2008, up to and including 11 a.m., Friday, July 25, 2008.
The Liquor Control Commission is satisfied that violations of the Liquor Control Act and Liquor Control Act Regulations took place under the following sections:
Sections 40(3) and 40(4) of the Liquor Control Act which read as follows:
Section 40(3) The holder of a liquor license shall not permit any person under the age of nineteen years to enter, be in, or remain in the licensed premises except as provided by the Act or regulations.
Section 40(4) The holder of a liquor license or his employee shall, before serving any person who appears to be under the age of nineteen years, demand proof that the person is of the age of nineteen years or over, and if the person refuses to furnish proof he shall not be served and on request of the holder of the liquor license or his employee , shall leave the premises and if he fails to do so is guilty of an offence.
and Sections (24) and (25) of the Liquor Control Act Regulations which read as follows:
Section (24) The holder of a lounge license shall not permit any person under the age of nineteen years to enter the licensed premises during the hours liquor is being consumed except where that person enters and is present in the premises under direct parental supervision or under the conditions set out in clauses 70(l) or (m).
Section (25) The licensee or person in charge of a lounge shall require evidence of the age of a person suspected to be under 19 years of age who is entering into or present on the premises of a lounge, in the manner prescribed by the Commission.
This suspension does not affect the operation of the dining room at the Causeway Bay Linkletter Inn and Convention Centre which may continue to observe its normal hours of operation during this period.
