Crown To Appeal Stays of Proceedings

The Crown Attorney's office today announced that it will appeal the stay of proceedings granted to Patrick A. MacDougall, in relation to a charge contrary to section 156 of the Criminal Code of Canada, as well as the stay of proceedings granted to Cory A. Gallant, who was charged with various offences contrary to section 348 (1)(b) and section 430 (4)(b) of the Criminal Code of Canada. These stays of proceedings were granted by Judge Gerald FitzGerald on September 24, 1996, as a result of applications under the Charter of Rights and Freedoms alleging undue delay by the Crown.

Following its review of the facts and the law relating to these cases, the Crown has determined that there are issues of law which merit determination by the Supreme Court of Prince Edward Island.

Appeal documents will be filed in the near future.
