Appeal from Producers Dismissed

The Natural Products Appeals Tribunal has dismissed an appeal from two potato producers who wanted a plebiscite to establish separate boards. The two producers, Blair Horne and Danny Hendricken, wanted their respective sectors to withdraw from the Prince Edward Island Potato Board. The appeal was filed following a decision by the Prince Edward Island Marketing Council not to authorize a plebiscite.

In a decision released recently, the Appeals Tribunal said decisions of the Marketing Council were not subject to appeal. Only orders, directions and/or regulations are subject to appeal. The Appeals Tribunal found that it did not have jurisdiction to hear the appeal.

The members of the Appeals Tribunal are Donald MacDonald, chair, Belinda Rogers and Colbourne Clow.
