License Suspended for Lt. Col. E.W. Johnstone R.C.L.

The Prince Edward Island Liquor Control Commission has suspended the Military Canteen License for the premises known as “Lt. Col. E.W. Johnstone R.C.L.,” license number MC 64 -0010, located in Kensington, P.E.I. for the following period of time, that is:

for a two (2) day period – commencing 11 a.m., Saturday, May 28, 2005, up to and including 1 a.m., Sunday, May 29, 2005 and commencing 11 a.m., Monday, May 30, 2005, up to and including 1 a.m., Tuesday, May 31, 2005.

The Liquor Control Commission is satisfied that violations of the Liquor Control Act regulations took place under the following sections:

In particular, violations of Sections 45(c) and Section 46 Liquor Control Act Regulations read as follows:

Section 45(c) Liquor Control Act Regulation:

“A military canteen licensee shall not permit any person under the age of nineteen years to enter, be in or remain in the rooms in which bars are located during the hours liquor is being consumed except where such person enters and is present in the room in which bars are located for the purpose of attending a wedding function or to provide entertainment under the conditions specified in clause 70(I).”

Section 46 Liquor Control Act Regulations:

“It shall be the duty and responsibility of the licensee or the person in charge to enforce the provisions of clause 45(b) and he shall demand that a birth certificate and such other evidence as may be required to establish age be shown by anyone he suspects of being under nineteen years of age before permitting that person to enter the premises.
