Province responds to abortion challenge

The Prince Edward Island government announced today that it will not oppose a constitutional challenge to provincial policies regarding access to in-province abortion services.

“Based on legal advice that current policies regarding access to in-province abortion services would likely be in violation of the Canadian Charter of Rights and Freedoms, government determined that the most responsible approach is to revise the policy rather than embark on a long and costly court case,” said Premier and Minister of Justice Wade MacLauchlan. “We recognize that Islanders, including Members of the Legislative Assembly, have strong personal beliefs on this issue; we also recognize our obligation to provide timely and professional health care, without discrimination.”

Health PEI has been directed to begin planning for a new women’s reproductive health centre on Prince Edward Island that will offer a number of reproductive health services, including medical and surgical abortions. Health PEI will report back on additional services to be provided, which could include pre- and post-natal counseling, fertility, and post-partum support services.

Health and Wellness Minister Robert Henderson has directed Health PEI to develop a business case for the new centre, to be located in a hospital setting.

“We recognize the importance of timely access to women’s reproductive health services. The co-location of services, including counseling and support services, will provide a wider level of support for women and the best use of public health care resources,” said Minister Henderson.

Minister Responsible for the Status of Women Paula Biggar acknowledged Islanders who have advocated on both sides of the abortion issue for many years.

“We have listened with respect to many voices and personal convictions on this topic,” said Minister Biggar. “Public policy must be reassessed and revised to ensure it stands the test of time. The decision we’re announcing today means that we will offer timely access to frontline services that align with women’s equality rights.”
